{"id":2128,"date":"2026-09-12T09:04:36","date_gmt":"2026-09-12T09:04:36","guid":{"rendered":"https:\/\/cnree.ro\/?p=2128"},"modified":"2026-09-12T09:04:36","modified_gmt":"2026-09-12T09:04:36","slug":"pasaportul-digital-al-bateriei-obligatii-aplicabile-din-februarie-2027","status":"publish","type":"post","link":"https:\/\/cnree.ro\/en\/pasaportul-digital-al-bateriei-obligatii-aplicabile-din-februarie-2027\/","title":{"rendered":"Digital battery passport: obligations applicable from February 2027"},"content":{"rendered":"<p class=\"wp-block-paragraph\">On 21 August 2026, the European Commission published the updated version of the guidance on the battery passport, an instrument provided for by Regulation (EU) 2023\/1542 concerning batteries and waste batteries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The document is addressed to economic operators in the battery value chain and outlines the information that must be made available starting from 18 February 2027. Regulation (EU) 2023\/1542 replaces Directive 2006\/66\/EC, which is repealed on 18 August 2025.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The act applies to all categories of batteries placed on the Union market\u2014regardless of chemical composition, shape, or intended use\u2014and establishes requirements covering the entire product life cycle: sustainability, performance, safety, recycled content, traceability, and end-of-life management. As a regulation, the act has direct effect in all Member States, requiring no transposition into national law. The updated guide published by the European Commission lists 71 data points relevant to batteries for electric vehicles, batteries for light means of transport, and industrial batteries. For each category, the document specifies whether the information is mandatory, optional, applicable only in certain situations, or not required to be completed or displayed as of the date the requirements take effect. The guide neither alters the obligations established by the regulation nor introduces new requirements. Its purpose is to organize the information stipulated by the basic act into a common structure, thereby facilitating preparations for economic operators and competent authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As of 18 February 2027, the obligation to hold a battery passport applies to the following categories placed on the market or put into service in the European Union:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>electric vehicle batteries;<\/li>\n\n\n\n<li>batteries for light means of transport (electric bicycles, electric scooters, and other similar means);<\/li>\n\n\n\n<li>industrial batteries with a capacity greater than 2 kWh.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis for this obligation is Article 77 of Regulation (EU) 2023\/1542. A particular feature of this mechanism must be highlighted: unlike other categories of digital product passports, the regulation mandates an individual passport for each battery unit\u2014linked to a unique identifier\u2014rather than a passport at the model or commercial reference level. Access to the information is provided via a data carrier affixed to the product, typically a QR code. Responsibility for the accuracy and updating of the data lies with the economic operator placing the battery on the market or putting it into service\u2014namely the manufacturer or importer\u2014including in cases where the information originates from suppliers. A battery that is reused, reconditioned, or intended for second-life use is legally considered a new product and requires a corresponding passport.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guide also mentions other obligations:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Battery removability and replacement<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As of 18 February 2027, portable batteries incorporated into products must be easily removable by the end-user, while batteries for light means of transport must be replaceable by a specialized operator. The Commission has published harmonized guidelines on the application of this requirement and is considering extending partial exemptions for certain product categories.\u00a0<\/li>\n<\/ul>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li>Supply chain due diligence obligations<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Initially applicable from August 18, 2025, these obligations were postponed until August 18, 2027, by a \"stop-the-clock\" legislative act adopted on July 18, 2025. They apply to operators with an annual turnover exceeding EUR 40 million and entail identifying and assessing environmental and social risks within the supply chain, adopting preventive measures, and annual reporting.\u00a0<\/li>\n<\/ul>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>Portable battery collection targets<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The regulation establishes a collection rate of 63% by 2027 and 73% by 2031. The time remaining until 18 February 2027 is shorter than it seems, as obtaining data from the supply chain is, in practice, the most time-consuming stage.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">CNREE recommends the following steps to economic operators:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1. identification of the battery categories within the portfolio and determination of those falling within the scope of the battery passport obligation;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">2. determination of the legal capacity held in relation to each product: manufacturer, importer, or distributor;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">3. inventorying the data requested in the Commission\u2019s guide and identifying information that is not currently available;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4. requesting missing data from suppliers, while establishing internal deadlines for responses;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">5. evaluation of the technical solutions required for generating the unique identifier, the data carrier, and the electronic record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Compliance with Regulation (EU) 2023\/1542 entails\u2014as is the case with other European traceability regimes\u2014the gradual development of a verifiable database. This approach aligns with the principle of rational sustainability that CNREE promotes in its dealings with economic operators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This material is for informational purposes only and does not constitute legal advice.
